BMS is a pharmaceutical laboratory focused on and dedicated to the commercialization of medicines in Spain, with a corresponding marketing authorization granted by the Spanish Agency for Medicines and Medical Devices under No. 1433E.

CONDITIONS OF USE

The usage of this website (“Site”), as well as all its subdomains and/or directories, applications and functions contained within it and the information linked to and communications made through it, are governed by this Legal Notice and Conditions of Use, as well as by the “Privacy Policy”, “Pharmacovigilance Notice” and applicable laws or regulations.

When entering and browsing the Site, You accept and acknowledge, without any limitation or qualification, that these documents supersede all prior agreements between You and BMS regarding your access to and use of the Site.

If any of the provisions contained in these Terms and Conditions or our Privacy Policy are declared null, the User and BMS agree that the rest of the provisions shall remain in full force and effect.

LACK OF MEDICAL INFORMATION

The Site does not provide medical advice or counseling. The information contained on the Site is not intended to replace the medical advice of a healthcare professional. If You need medical counseling, contact a healthcare professional. 

INTELLECTUAL AND INDUSTRIAL PROPERTY

The entire content of the Site belongs to BMS, the companies in its Group or to BMS collaborating entities, and it is protected by the corresponding intellectual and industrial property rights. The simple use or access of the Site and/or its services and/or content shall in no way entitle the User to any rights over them. The usage license for the entire content of the Site is of non-exclusive nature. The User is limited to accessing and downloading said content exclusively for his/her private use, provided that said content remains complete. The User hereby undertakes to not using the downloaded content for any purpose other than for the one provided herein. Any other use of the Site content without the prior written consent of BMS is strictly prohibited.

The trademarks, trade names, logos or service marks (hereinafter collectively the “Trademarks”) that appear on the Site are registered trademarks, trademarks in the process of registration or unregistered trademarks that belong to BMS, the companies that belong to its Group or others. Under no circumstances will the use or access of the Site entitle the User to any right or usage license for the Trademarks without the prior written consent of BMS. The use of the Trademarks and any other content from the Site is strictly prohibited, unless an exception is expressly stipulated in these Conditions of Use. Please be aware that BMS shall make use of all legal actions available to it under the current legislation in order to defend its intellectual and industrial property rights, including the filing of criminal complaints, if necessary.

LIABILITY DISCLAIMER

Even though BMS makes all reasonable efforts to ensure that all the information on the Site is accurate and updated, technical inaccuracies or typos may exist. BMS disavows all liability, to the maximum extent permitted by current legislation, for any errors or omissions in the content of the Site. BMS reserves the right to make changes to the Site in order to update, rectify, modify, add or delete content. Furthermore, BMS disavows any liability arising from the use of the Site that is contrary to these Conditions of Use, the Privacy Policy and applicable law. Everything on the Site is provided to You “AS IS”, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. 

Under no circumstances shall BMS be liable for any use of the Site that is contrary to these Conditions of Use, the Privacy Policy and current legislation. Users shall bear the full responsibility for their use of the Site.

LIMITATION OF LIABILITY

BMS provides the entire content of the Site in good faith and shall make its best efforts to keep it permanently updated and effective, both to control the adequacy of the content and Users’ access to it, in accordance with the current legislation. However, they are entirely liable for their browsing and use of the Site. Neither BMS nor any other party involved in the creation, production or delivery of the Site is liable for damages of any kind that could arise from the use of the Site.

BMS undertakes to apply the required measures to try to guarantee the User against viruses and other similar harmful elements on the Site. These measures are not foolproof. Therefore, BMS is not able to completely ensure the absence of these harmful elements. BMS does not assume any liability, nor shall it be liable, for any harm or virus that could infect computers or other property in relation to the access, use and browsing of the Site or the downloading of any material, data, text or images contained therein.

DELIVERY AND EXCHANGE OF INFORMATION

Certain areas of the Site may allow the User to access online forums, blogs, chats or social networks, to deliver or receive comments, opinions, materials or any kind of information, as well as to send emails or contact BMS by other means. BMS does not endorse the content of these forums and is holds no responsibility for it (the User shall bear the full and sole responsibility for the information, data, comments, opinions and materials he/she sends.). It is strictly forbidden to publish or transmit any kind of comment, opinion, information or material contrary to ethics, morals and public order, or that is illegal, false, unfair, biased, excessive, inadequate, inaccurate, threatening, abusive, defamatory, obscene, insulting, offensive, pejorative, indecent, instigating, pornographic, irreverent, capable of producing disrepute, that may constitute a crime or lead to a behavior that could be considered as such, that could give rise to civil liability suits, break any applicable law or code of conduct of the pharmaceutical industry or that may prove inadequate for its recipients. Furthermore, it is expressly prohibited to publish or transmit any kind of comment, opinion, information, or material that: a) violates the rights of third parties, such as the right to privacy and self-image; b) is protected by intellectual property rights, industrial property rights or rights of other types, without the prior written consent of the owner of such rights; c) contains viruses, errors, or any other kind of harmful elements; or d) constitutes an act of illicit collusion against a third party to the detriment of free competition. The User is liable for the damages arising from the violation of intellectual property rights, industrial property rights or rights of other types, as well as any other damage derived from the use of the Site.

Notwithstanding the foregoing, BMS reserves the right to decline Users access to the Site whenever it becomes aware that such a User has committed any kind of infringement (such as the delivery of illicit content that is contrary to the morals or public order or in any way contrary to these Conditions of Use, or use of the Site in such a way that the image of BMS or its Group is damaged), as well as to remove inadequate content.

RELEASE OF PERSONAL DATA BY THE USER

The submission of personal data or information that allows the identification of a person to the Site through electronic communication shall be subject to the Privacy Policy. On the other hand, any communication or material that does not contain personal data and that the User sends through email or other means—such as data, queries, comments or suggestions—shall be considered as non-confidential and non-patented information. With the exception of personal data whose processing is governed by the Privacy Policy, all information sent or published by the User may be used by BMS or its Group companies for purposes that they deem appropriate, including but not limited to: reproduction, disclosure, transmission, publication, release and broadcast. Furthermore, Bristol Myers Squibb is free to use any idea, concept, knowledge, process or method contained in any communication sent through the Site for any purpose, including, among others: the development, production, marketing and sale of products and services using such ideas, concepts, knowledge, processes and methods.

The User shall be liable for any data or information provided that proves to be false or incorrect, as well as for any damage or loss caused to BMS or third parties as a result of the transmission by the User of false or incorrect information, data or opinions.

LINKS TO OTHER WEBSITES

Links to other websites not controlled by BMS are used to provide access to other information, but under no circumstances do they imply that BMS endorses or recommends the content therein. BMS does not control linked websites and will not assume any responsibility for their content or management. Visiting other sites outside of the Site is done at the risk and expense of the User. We recommend reviewing the legal notice and privacy policy of other websites when accessing them.

MODIFICATION

To the extent permitted by the current legislation, BMS reserves the right to modify, without prior notice, these Conditions of Use when it deems appropriate, in order to adapt them to legal developments, judicial resolutions, industry practices or for any other reason. All modifications will be communicated via the Site.

Users shall be bound by the new terms and conditions modified from the moment of their publication, which is why we suggest reviewing these Conditions of Use regularly.

Furthermore, BMS may regularly modify or temporarily or permanently suspend the Site, as well as remove all or part of its content or any or all of its functions or services.

APPLICABLE LAW AND JURISDICTION

The applicable law in the event of dispute or conflict of interpretation of the terms comprising these Conditions of Use, the Privacy Policy and, where appropriate, the corresponding particular conditions and any legal notices, regulations, or instructions, brought to your knowledge through the Site or electronic communications related to it, as well as any issue related to the services offered through the Site, shall be the Spanish law.
For cases in which the law allows the parties the possibility to voluntarily submit themselves to a jurisdiction, the User and BMS agree to submit themselves to the Courts and Tribunals of Madrid (capital) for the resolution of any conflict that may arise in relation to the visit or use of the Site.
